General Terms and Conditions
§ 1Scope and Provider
1.1 Our following General Terms and Conditions (GTC) apply to all orders of goods and services made by a consumer through the online shop www.ambermul.com.
1.2 A consumer in the sense of the law (§ 13 BGB) and these GTC is a natural person with whom we enter into business relations, without this being predominantly attributed to commercial or self-employed professional activities.
1.3 If you are under 18 years old, the involvement of a legal guardian is required.
1.4 The contract language is exclusively German.
1.5 You can access and print the currently valid General Terms and Conditions on the website.
§ 2 Conclusion of Contract
2.1 The presentation of goods in the online shop does not constitute a binding offer for the conclusion of a purchase contract. Rather, it is an invitation to order goods in the online shop.
2.2 By clicking the button "Order now with payment obligation," you make a binding purchase offer (§ 145 BGB).
2.3 Upon receipt of the purchase offer, you will receive an automatically generated email confirming that we have received your order (confirmation of receipt). This confirmation of receipt does not yet constitute acceptance of your purchase offer. A contract is not concluded by the confirmation of receipt.
2.4 A purchase contract for the goods is only concluded when we expressly declare acceptance of the purchase offer or when we dispatch the goods to you without a prior express declaration of acceptance.
§ 3 Prices
The prices stated on the product pages include the statutory value-added tax and other price components and are exclusive of the respective shipping costs.
§ 4 Delivery and Reservation of Self-Delivery
4.1 If not all ordered products are available, we are entitled to partial deliveries at our expense, as long as this is reasonable for you.
4.2 We expressly reserve the right to withdraw from the contract if we are unable to deliver the ordered goods without our fault because the supplier does not fulfill its contractual obligations. In such a case, we will inform you immediately about the unavailability of the goods and will refund any payments made by you promptly.
§ 5 Retention of Title
The delivered goods remain our property until full payment has been made. Prior to the transfer of ownership, pledging, assignment as security, processing, or transformation without our express consent is not permitted.
§ 6 Shipping
6.1 All prices listed include statutory sales tax and other price components, excluding applicable delivery and shipping costs.
6.2 With the updating of the website, all previous prices and other information about goods become invalid. The version valid at the time of ordering is authoritative.
6.3 When purchasing and subsequently shipping our goods, we charge shipping costs. The shipping costs will be clearly communicated to you under Shipping and Returns or on the order page.
§ 7 Payment Terms
For all orders, the following payment options are offered:
- Invoice (Klarna)
- PayPal
- Credit Card (Visa, Mastercard, American Express)
7.1 Klarna Installment Purchase With the financing service Klarna Installment Purchase, you will also receive the goods first. All your purchases will then be compiled into one invoice at the end of the next month. You can pay this invoice in flexible installments or settle the total amount at any time. 7.4 In the event of a chargeback for which you are responsible due to insufficient funds in the specified bank account, a dispute against our withdrawal, or incorrect entry of bank details, you may be liable for any costs incurred as a result of the payment transaction. Of course, you can always demonstrate that the fees were lower in individual cases. In this case, you are only obliged to pay the lower amount.
§ 8 Cancellation Policy
In the event that you are a consumer within the meaning of § 13 BGB, meaning you are making a purchase for purposes that predominantly cannot be attributed to your commercial or independent professional activity, you have the right to cancel in accordance with the following provisions.
Right of Cancellation
You have the right to revoke this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.
To exercise your right of cancellation, you must inform us via:
Email: [email protected]
by means of a clear statement (e.g., a letter sent by post or email) of your decision to cancel this contract. You may use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the notification regarding the exercise of the right of cancellation before the cancellation period has expired.
Consequences of Cancellation
If you revoke this contract, we will reimburse all payments received from you, excluding the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us, without delay and at the latest within fourteen days from the day on which the notification of your cancellation of this contract was received by us. We will use the same payment method for this reimbursement that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold the reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return the goods promptly and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
The costs of return shipping shall be borne by the buyer. For full returns from Germany and Austria, we will offset the return shipping costs with the shipping costs. This will not incur any additional costs for you. Please also include the completed return slip provided.
We reserve the right to refuse acceptance of returns from outside the DACH region.
You will only be liable for any diminished value of the goods if this loss in value is attributable to handling them in a manner not necessary for examining their nature, characteristics, and functioning.

§ 9 Special note
9.1 The right of withdrawal does not apply to the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (e.g. individual ballerinas, self-designed dirndls and jackets), to the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery or to the delivery of sound or video recordings or computer software in a sealed package if the seal was removed after delivery.
Cash payment, return or denomination of a gift voucher is not possible.
9.2 Some products have a pink seal with numbering and are sent in this way. When trying on the goods, please be careful not to damage or remove the seal. Only products with an original seal have a 14-day right of withdrawal.
9.3 Please avoid damage and contamination. We can only accept returns of goods that have not been worn and are in perfect condition. A successful return is only possible if the items are free of make-up, stains, residues and strong odors such as perfume, sweat or detergent. Please send the goods back to us in their original packaging with all accessories and packaging components if possible. Use protective outer packaging if necessary. If you no longer have the original packaging, please ensure that you use suitable packaging to ensure adequate protection against transport damage in order to avoid claims for damages due to inadequate packaging.
§ 10 Warranty
The statutory warranty provisions apply.
§ 11 Data protection provisions
We process data in accordance with the applicable Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). For further information, please refer to the information in the data protection declaration.
§ 12 Liability
12.1 Unlimited liability: We are liable for intent and gross negligence. We are liable for minor negligence in accordance with the Product Liability Act and for damages resulting from injury to life, body or health.
12.2 Limitation of liability: In the case of minor negligence, we are only liable for the breach of a material contractual obligation, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligation). This limitation of liability also applies to our vicarious agents.
§ 13 Final provisions
13.1 German law applies to the conclusion and execution of all contracts. However, this only applies to you as a consumer to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which you have your habitual residence.
13.2 The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.
13.3 If one or more provisions of these General Terms and Conditions are invalid, this does not result in the invalidity of the entire contract. The invalid provision will be replaced by the applicable statutory provision.
